Terms of service

These General Terms and Conditions of Sale and Service (“Terms”) govern purchases made through the Shopify store Atelier del Vino by Grande Passione, available at atelier.grandepassione.com, as well as the use of products and services purchased through the store.

Atelier del Vino is the name of Grande Passione’s physical retail and event space at the same address.

The Italian version of these Terms is the reference text. The English version is provided for the convenience of international customers.

1. Scope

Grande Passione may offer through the store, among other things:

  • tickets for tastings, events and experiences;
  • courses and educational programmes, including WSET courses;
  • books and other physical goods;
  • digital documents, books and other digital content;
  • memberships and access to restricted content, when available;
  • private tastings;
  • gift experiences and vouchers;
  • other products or services described on the store.

Under the current store configuration, Grande Passione does not sell wine online.

Physical goods purchased online are normally available for collection from Atelier del Vino. Shipping may be offered for specific products or materials, for example where indicated for course materials. The applicable arrangements and any costs are stated on the product page or at checkout.

Wine purchased at Atelier del Vino is not shipped.

2. Consumers and business customers

For the purposes of these Terms, a “Consumer” is an individual purchasing for purposes outside their business, trade, craft or professional activity.

Certain products and services may also be purchased by businesses or professionals. Rights specifically granted to consumers under the Italian Consumer Code apply only where the relevant requirements are met.

3. Product and service information

The essential characteristics, price, date or duration where applicable and principal conditions of each product or service are stated on the relevant store page.

For events, tastings and courses, the programme, wines, speakers, guests or other elements may be changed where reasonably necessary for organisational or educational reasons, availability or circumstances beyond Grande Passione’s control.

Any substitutions will seek to preserve the nature, level and value of the experience. Where a change materially alters the service purchased, the rights provided by law and, where appropriate, the possibility of requesting a refund will remain available.

4. Orders and formation of the contract

To make a purchase, the customer must provide the information requested at checkout and verify that it is correct before confirming the order.

Submitting an order creates an obligation to pay the stated price.

The contract is concluded when Grande Passione sends the order confirmation, subject to successful payment where the selected payment method requires immediate authorisation.

Where a deferred or manual payment method is offered, such as bank transfer, the order may be received and recorded before payment is actually received. Supply of the product or service may remain conditional upon receipt of payment, as stated at the time of purchase.

The confirmation is sent to the email address provided by the customer and contains, or allows the customer to retrieve, the essential information relating to the purchase.

If, exceptionally, a product or service becomes unavailable after the order is placed, Grande Passione will promptly inform the customer and refund any sums already received, unless the customer expressly chooses an alternative solution offered.

5. Prices and currencies

The store’s reference currency is the euro.

Depending on the market, the customer’s country and the payment services available, some prices may be displayed or charged in another currency.

Consumer prices include VAT and other applicable taxes where due, as indicated on the store and at checkout.

For sales or services involving an international element, tax treatment may vary according to the nature of the product or service and the applicable rules.

The price and currency finally applicable are those displayed and confirmed at checkout when the order is placed.

6. Payments

Available payment methods are displayed at checkout and may include Shopify Payments, Shop Pay, Apple Pay, Google Pay, PayPal, Satispay, bank transfer or other methods subsequently made available.

The availability of a particular payment method may vary depending on the product, country, currency or type of customer.

Some payment services are provided directly by third parties and may also be subject to their own terms.

Grande Passione does not normally retain full payment-card details.

An order may be suspended or refused where payment is not authorised or where security systems identify reasonable evidence of fraud or unauthorised use.

For WSET course bookings paid by a company by bank transfer, full payment must be received within 7 calendar days of booking and no later than 10 days before the course starts, whichever is earlier. Please include the order number and participant’s name in the payment reference.

7. Invoicing

Customers requesting an invoice must provide the complete fiscal information required during the purchase process, including, where applicable, Italian tax code, VAT number, billing address, PEC or recipient code.

Electronic invoices are issued in accordance with applicable Italian tax law.

Where tax rules require an invoice to be requested at the time of purchase, a later request may not be capable of being accepted.

8. Customer accounts

Grande Passione uses Shopify Customer Accounts.

Customers may access their account using their email address and the authentication system made available by Shopify to view orders and use other available functions, including, where applicable, cancellation or return requests, access to digital products and future restricted services.

Customers are responsible for:

  • the accuracy of the information provided;
  • the security of access to their email and account;
  • activities carried out through their account.

Access codes or other authentication tools must not be shared with third parties.

Grande Passione may temporarily suspend an account where there are reasonable security concerns or suspected misuse. In the event of a material breach of these Terms, access may be restricted or revoked, subject to the customer’s mandatory legal rights.

9. Physical goods, collection and shipping

Physical goods purchased online are normally available for collection at:

Information concerning availability for collection is provided with the order or subsequently by email.

For certain specific products, including course materials where applicable, shipping may be offered when expressly indicated on the product page or at checkout.

Grande Passione’s Return and Refund Policy applies to returns, withdrawal rights and refunds relating to physical goods.

The fact that a product purchased online is collected from Atelier del Vino does not change the distance-contract nature of the purchase or remove any statutory withdrawal rights that may apply.

Wine is not ordered or shipped through the online store under the current configuration.

10. Dated events and tastings

Tickets for tastings, events and leisure experiences providing a specific date or period of performance fall, where the relevant requirements are met, within the exception provided by Article 59(n) of the Italian Consumer Code.

In those circumstances, the ordinary 14-day right of withdrawal does not apply.

Grande Passione nevertheless voluntarily provides the following cancellation policy:

Cancellation by the customer at least 7 calendar days before the event: full refund of the ticket price.

Cancellation within the 7 days preceding the event or failure to attend: the ticket is non-refundable. The customer may transfer the place to another person eligible to participate, provided Grande Passione is informed before the event begins.

A voluntary cancellation request may be made using any booking-management functions made available or by writing to contact@grandepassione.com.

Any more favourable conditions stated on the page of a particular event prevail.

11. Cancellation or rescheduling of an event by Grande Passione

If Grande Passione cancels an event, the customer may choose between:

  • a full refund of the amount paid; or
  • transfer of the amount to another date or activity proposed by Grande Passione and accepted by the customer.

If an event is postponed or moved to another date, the customer may accept the new date or request a full refund.

To the extent permitted by law, Grande Passione is not responsible for travel, accommodation or other expenses independently incurred by the participant and not included in the contract with Grande Passione.

12. Courses and educational programmes

Courses are services and, where purchased online by a Consumer, are normally subject to the right of withdrawal provided by the Italian Consumer Code for 14 days from conclusion of the contract, unless a specific statutory exception applies.

Where the course or part of the service is due to begin during the withdrawal period, Grande Passione will, where required under applicable law, obtain the Consumer’s express request for performance to begin before that period expires.

If the customer expressly requests that the course or part of the service begin during the withdrawal period and subsequently withdraws, the customer may be required to pay an amount proportionate to the service already supplied, where provided by law.

Cancellations and date changes

The commercial cancellation policy is separate from the statutory right of withdrawal and does not restrict its exercise.

For WSET courses, you may cancel at least 14 days before the first teaching day and receive a refund, subject only to the conditions for textbooks received, returned or retained set out in the WSET policy. No administration, examination or registration fees will be deducted.

You may change dates more than once, provided each change is made at least 14 days before your currently booked course begins and places are available on a course at the same level. For changes involving a price difference, contact us before proceeding.

For cancellations after this deadline, non-attendance, booking management and study materials, please consult the WSET Cancellation and Refund Policy. That policy governs these matters and takes precedence over any conflicting commercial provisions in these Terms.

For other courses, the commercial cancellation and transfer conditions are stated on the relevant course page before purchase. Consumers’ mandatory statutory rights remain unaffected.

13. WSET and other external organisations

Where a course includes qualifications, examinations, registrations or materials provided by WSET or another external organisation, that organisation’s administrative and examination rules may also apply.

Relevant conditions will be communicated where applicable.

The rules of external organisations do not alter the customer’s refund rights under the applicable cancellation policy and the law. For WSET courses, the WSET Cancellation and Refund Policy referred to in section 12 applies.

14. Cancellation or postponement of a course by Grande Passione

Grande Passione may postpone or cancel a course for organisational reasons, insufficient enrolment, instructor unavailability, force majeure or other circumstances making the planned delivery reasonably impossible.

If a course is cancelled, the customer may choose between:

  • a full refund of the amount paid to Grande Passione; or
  • transfer to another agreed course.

If a course is postponed, the customer may accept the new date or request a refund.

15. Digital content

Digital products may include books, PDFs, guides, frameworks, study materials and other content supplied by download or online access.

Where immediate supply of digital content on a non-tangible medium is offered, before supply begins the Consumer is asked, where required by law:

  1. to expressly consent to supply beginning during the withdrawal period;
  2. to acknowledge that, once supply begins under the conditions provided by law, the right of withdrawal will be lost.

For products configured for immediate supply, consent is requested separately before checkout and recorded with the order.

Once the purchase has been completed, Grande Passione provides the required confirmation on a durable medium, normally through the email that makes the digital content available.

Where all requirements provided by Article 59 of the Italian Consumer Code are satisfied, the right of withdrawal relating to that digital content ends when supply begins.

Where those requirements are not satisfied, the rights provided by law remain applicable.

Rights concerning the legal conformity of digital content and digital services remain unaffected.

16. Digital-content licence

Unless otherwise stated, purchase of digital content grants the customer a personal, limited, non-exclusive and non-transferable licence for personal or internal professional use.

The purchase does not transfer copyright or other intellectual-property rights.

Without Grande Passione’s written permission, customers may not:

  • distribute or resell the content;
  • share it publicly or with persons who have not purchased the relevant right of access;
  • reproduce substantial quantities for commercial purposes;
  • remove copyright or attribution notices;
  • systematically upload the content to public or shared repositories;
  • use the content as a dataset for training artificial-intelligence systems or machine-learning models.

Any materials belonging to WSET or other parties remain the property of their respective rights holders.

17. Membership

Grande Passione membership is not currently available for purchase.

Before any future launch, the access model, duration, price, any renewal arrangements, cancellation methods and other applicable conditions will be defined.

If a membership is offered in the future, the relevant page will clearly state before purchase:

  • the duration of the service;
  • the price;
  • the benefits included;
  • any automatic renewal and its frequency;
  • how renewal may be prevented;
  • the conditions governing access and termination;
  • any applicable withdrawal rights.

The specific conditions communicated at the time of purchase will supplement these Terms.

Reminder in the event of automatic renewal

If a fixed-term membership with automatic renewal is introduced, Grande Passione will send the Consumer, 30 days before expiry, the notice required by applicable law, stating the date by which cancellation may be submitted.

If that notice is not sent where required by Article 65-bis of the Italian Consumer Code, the rights granted to the Consumer by that provision remain applicable.

18. Withdrawal from membership

If a membership is offered online to Consumers in the future, the applicable withdrawal rights will depend on the actual nature of the service offered.

If the Consumer requests activation of the service during the withdrawal period, the rules concerning the part of the service already supplied may apply where provided by law.

Where a membership includes immediately supplied digital content, any loss of the right of withdrawal relating to that content will be subject to the specific requirements governing digital content.

The final conditions will be established before the membership is launched.

19. Use of membership

If membership is introduced, it will be personal unless expressly stated otherwise.

Customers will not be permitted to share credentials, systematically provide restricted content to third parties or use access to create a competing library, archive or service.

The final rules governing access, use, renewal, suspension and termination will be stated in the membership conditions applicable at the time of purchase.

20. Private tastings

A private tasting may be purchased for a specific date or booked subsequently using a voucher.

For private tastings booked for a specific date:

  • cancellation at least 7 days beforehand: full refund;
  • cancellation within the preceding 7 days: no refund.

In the latter case, Grande Passione may allow one change of date, on request, subject to availability and any costs already incurred.

If Grande Passione cancels the tasting, the customer may choose between a new date and a full refund.

21. Gift experiences and vouchers

Vouchers without a date already fixed are normally valid for 12 months from the date of purchase, unless a longer period is stated on the product page.

Booking is subject to availability and must be requested during the voucher’s validity period.

A voucher may be transferred to another person before use unless expressly stated to be personal.

Once a voucher is used to book an activity for a specific date, the cancellation conditions applicable to that activity apply.

For vouchers purchased online, any statutory right of withdrawal remains applicable where the relevant requirements are met.

After expiry of the statutory withdrawal period, a voucher is not redeemable for cash except where required by law. An extension of validity may be agreed with Grande Passione.

22. Activities involving alcoholic beverages

Grande Passione does not sell wine online under the current store configuration.

Events, courses, tastings and experiences involving the tasting or serving of alcoholic beverages in Italy are restricted to participants aged 18 or over.

Participants may be asked to show identification where their age is not clearly apparent.

Where the age requirement was clearly stated before purchase and the participant does not meet it, Grande Passione may refuse participation in the tasting.

Grande Passione may also refuse or stop serving alcohol where necessary to comply with the law or protect the safety of the participant or others.

Responsible consumption and arrangements for transport following an event remain the participant’s responsibility.

23. Right of withdrawal

Where the Italian Consumer Code grants the Consumer a right of withdrawal, the ordinary period is 14 days, beginning according to the nature of the contract.

The Consumer may exercise it:

  • through the Exercise your right of withdrawal link available on the store, accessing the relevant order through Shopify Customer Accounts and using the corresponding function where the right applies; or
  • by sending an explicit statement to contact@grandepassione.com.

When the online function is used, the Consumer can identify the relevant order and confirm the withdrawal request. Grande Passione transmits confirmation of the request on a durable medium without undue delay, in accordance with the system used and applicable law.

The existence of the online function does not limit the possibility of exercising the right by other means permitted by law.

You may use the model withdrawal form at the end of these Terms, but this is not mandatory. It is sufficient to send an explicit statement before the withdrawal period expires.

When the statutory right of withdrawal is validly exercised, Grande Passione will issue the refund without undue delay and no later than 14 days after receiving the withdrawal notice, using the same payment method used for the purchase, unless expressly agreed otherwise without any cost to the Consumer.

For contracts for the sale of goods, the refund may be withheld until the goods have been received or proof of their dispatch has been provided, whichever occurs first, unless Grande Passione has offered to collect them. Goods must be returned within 14 days of notifying us of withdrawal.

Proportionate charges for services begun at the Consumer’s express request and any reduction in the value of goods remain applicable only in the circumstances and to the extent permitted by law.

The right of withdrawal does not apply where an exception under Article 59 of the Italian Consumer Code applies, including, where relevant:

  • leisure activities providing a specific date or period;
  • digital content supplied immediately following express consent and acknowledgement of the loss of the right, where all statutory requirements are satisfied;
  • other cases specifically provided by law.

The Return and Refund Policy also applies to physical goods.

24. Legal guarantee of conformity

Consumers benefit from the statutory legal guarantee of conformity.

For new goods, the statutory guarantee applies in accordance with the Italian Consumer Code and normally lasts two years from delivery.

Digital content and digital services are also subject to the statutory conformity requirements provided by the Italian Consumer Code.

Any commercial guarantees or policies offered by Grande Passione do not restrict those rights.

25. Intellectual property

The Grande Passione name, texts, books, photographs, educational materials, frameworks, publications, any restricted content, graphics and other original material are protected by applicable intellectual-property law.

Access to the store or purchase of a product does not transfer those rights except as expressly provided in these Terms or in a specific product licence.

26. Use of the store and services

Customers undertake not to use the store, accounts or services to:

  • engage in unlawful or fraudulent activities;
  • interfere with the security or operation of systems;
  • introduce malware or harmful code;
  • gain unauthorised access to accounts or content;
  • systematically collect data or content using automated tools where this would breach the law or Grande Passione’s rights;
  • infringe intellectual-property rights;
  • harass other participants, customers or collaborators.

27. Conduct during events and courses

Grande Passione seeks to provide a respectful, safe and enjoyable environment.

A participant may be asked to leave an activity in the event of seriously disruptive, dangerous, discriminatory or aggressive behaviour, or behaviour that seriously compromises the experience or safety of others.

Where removal results from a serious breach attributable to the participant, no refund is due for the unused part of the activity, except where otherwise required by law.

28. Force majeure

Grande Passione is not responsible for delays or inability to perform resulting from circumstances reasonably beyond its control, such as natural events, public emergencies, measures imposed by authorities, sudden and unavoidable unavailability of premises or instructors, significant transport disruption or similar events.

Where such circumstances result in cancellation or postponement of an event or course, the relevant refund and rescheduling provisions contained in these Terms will apply.

29. Liability

Grande Passione is responsible for performing its obligations in accordance with the contract and applicable law.

Nothing in these Terms limits or excludes:

  • the Consumer’s mandatory rights;
  • liability that cannot legally be excluded or limited;
  • liability for wilful misconduct or gross negligence where provided by applicable law.

To the extent permitted by law, Grande Passione is not responsible for indirect losses or consequences that were not reasonably foreseeable when the contract was concluded.

30. Shopify

The store is hosted and supported by Shopify.

Shopify is not the seller of Grande Passione products or services and is not a party to the contract between Grande Passione and the customer, except in relation to any services that Shopify provides directly to the customer under its own terms.

Personal data is processed in accordance with the Privacy Policy.

31. Complaints

For any issue relating to an order or service, customers are invited to contact:

Grande Passione will seek to resolve complaints directly and within a reasonable period.

Consumers may also use, where applicable, Alternative Dispute Resolution (ADR) bodies provided for under applicable consumer law.

Grande Passione does not currently commit in advance to a specific ADR body, unless otherwise required by law or agreed in an individual case.

32. Governing law and jurisdiction

These Terms and contracts concluded with Grande Passione are governed by Italian law.

For Consumers resident in another country, the choice of Italian law does not result in the loss of any mandatory protections that would apply under the law applicable in the absence of that choice.

For Consumers resident or domiciled in Italy, the competent court is the court of the Consumer’s residence or domicile where provided by Article 66-bis of the Italian Consumer Code.

For customers acting in the course of their business or professional activity, the Court of Verona has exclusive jurisdiction unless mandatory law provides otherwise.

33. Changes to these Terms

Grande Passione may update these Terms to reflect changes to its services, technology, organisation or applicable law.

Changes apply to purchases made after publication unless otherwise required by law.

For any continuing services, material changes will be communicated where required by applicable law and will not prejudice rights already accrued.
